Terms of Service

1. Agreement

These Terms of Service (“Terms”) form a binding agreement between you and Visuan, operated by Tetiana Zhydkova, Individual Entrepreneur, registered in Ukraine (“Visuan”, “we”, “us”), governing your access to and use of the Visuan website, applications, and services (collectively, the “Service”). By creating an account or using the Service you agree to these Terms, our Privacy Policy, and our Refund Policy.

2. The Service

Visuan is an AI-assisted tool that generates branded visual proposals from predesigned templates. Output is provided on an “as is” basis. You are responsible for reviewing AI-generated content for accuracy, suitability, and rights clearance before any commercial use.

3. Accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for the activity on your account and for keeping your credentials secure.

4. Acceptable use

You agree not to:

• break the law or infringe anyone’s rights;
• upload content you do not have the right to use;
• attempt to reverse-engineer, scrape, or interfere with the Service;
• use the Service to generate misleading, defamatory, hateful, or sexually explicit material involving real people without consent.

5. Your content

You keep ownership of the content you upload and of the proposals you generate. You grant Visuan a limited licence to host, process, and display that content solely to operate and improve the Service.

6. Subscriptions and payment

Paid plans are billed in advance through Paddle, our payment processor and merchant of record. Subscriptions renew automatically at the end of each billing period until cancelled. Refunds are governed by our Refund Policy, which forms part of these Terms. We may change pricing with reasonable advance notice.

7. Termination

You can close your account at any time. We may suspend or terminate access if you breach these Terms or use the Service in a way that risks harm to us or other users.

8. Disclaimers and liability

The Service is provided “as is” and without warranties of any kind. To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the claim.

9. Changes

We may update these Terms from time to time. Material changes will be announced in-product or by email at least 14 days before they take effect.

10. Governing law

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules. Disputes that cannot be resolved through good-faith negotiation shall be submitted to the courts of Ukraine at the location of the seller’s registered address (Lutsk, Ukraine). If you are a consumer residing in the European Union, you retain the right to bring proceedings in the courts of your country of residence under applicable consumer-protection law.
